2.1 Account Creation

To access tournament management features, purchase tournament credits, or sync match data across devices, you must register for an account. You agree to provide accurate, current, and complete information during registration and keep your account details updated at all times.

2.2 Credential Confidentiality & Responsibility

You are solely responsible for maintaining the confidentiality of your username, password, and authentication tokens. You accept full responsibility for all activities and transactions conducted under your account credentials. You agree to immediately notify Qlutch of any unauthorized access, security incident, or breach.

2.3 Prohibited Misrepresentation & Termination

You agree not to misuse or share your login credentials, misrepresent your identity or club affiliation, impersonate any person or entity, or create accounts through automated means. Qlutch reserves the right to suspend or terminate accounts that violate these security standards.

3.1 Limited License Grant

Subject to your compliance with these Terms, Qlutch grants you a limited, non-exclusive, non-transferable, revocable license to access and use the mobile application and tournament web platform solely for your personal or authorized padel club organizational purposes.

3.2 Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the Services for any unlawful, fraudulent, or unauthorized purpose under the laws of Indonesia or your jurisdiction
• Reverse engineering, decompiling, disassembling, or attempting to derive the source code of the application, tournament engine, or scoring algorithms
• Interfering with, overloading, attacking, or disrupting the integrity, performance, or servers of the Services
• Using automated scripts, bots, spiders, crawlers, scrapers, or data mining tools to extract content or match statistics without authorization
• Attempting to gain unauthorized access to other user accounts, servers, payment endpoints, or backend infrastructure
• Uploading or introducing viruses, worms, Trojan horses, malware, or other malicious code
• Harassing, abusing, stalking, threatening, or infringing upon the legal rights of other players, referees, or tournament organizers
• Reselling, sublicensing, leasing, or commercializing tournament software licenses or credits outside authorized platform mechanisms
• Falsifying, tampering with, or manipulating match scores, tournament brackets, leaderboard outcomes, or official player ratings
• Removing, altering, or obscuring any proprietary notices, copyright labels, trademarks, or watermarks on the platform

4.1 Digital Tournament Credits

Qlutch provides a web-based tournament operating platform (https://tournament.qlutch.id) and companion mobile application. Organizers purchase digital Tournament Credits ("Credits") to create, configure, officiate, and broadcast structured padel tournaments. Credits represent digital service licenses to host events on our infrastructure.

4.2 Credit Consumption Rules

Each tournament event consumes credits based on draw size: standard events with up to 32 teams consume 1 (one) Credit, while large tournament draws exceeding 32 teams consume 2 (two) Credits. Credits are deducted from your balance upon publishing or generating live tournament draws.

4.3 Platform Features & Precision

We make every reasonable effort to ensure our tournament tools, live scoring sync, snake draws, knockout bracket generators, tiebreaker algorithms (+PD), and stadium 4K TV displays function accurately and reliably. However, local display rendering and colors may vary based on your screen hardware.

5.1 Mandatory Indonesian Rupiah (IDR) Currency

In strict compliance with Bank Indonesia regulations (PBI No. 17/3/PBI/2015 regarding the Mandatory Use of Rupiah in the Territory of the Republic of Indonesia), all prices, credit package tiers, and transaction amounts across the Qlutch ecosystem are denominated, displayed, and settled exclusively in Indonesian Rupiah (IDR / Rp).

5.2 Authorized Payment Gateways & Methods

Payments for digital Tournament Credits are processed securely through authorized Indonesian Payment Gateway providers (including Midtrans) and certified banking channels. Supported payment methods include QRIS (GoPay, OVO, ShopeePay, Dana, LinkAja, BCA QRIS), Virtual Accounts (BCA, Mandiri, BNI, BRI, Permata, and other banks), Credit / Debit Cards (Visa, Mastercard, JCB), and direct Bank Transfers. All transactions are subject to the security and verification standards of the respective payment gateway.

5.3 Price Adjustments & Pricing Error Correction

Qlutch reserves the right to modify, adjust, or update package fees and promotional pricing at any time without prior notice. In the rare event that a credit package is mistakenly listed at an incorrect price due to a typographical or system error, Qlutch reserves the right to refuse, cancel, or void the order, and promptly refund any amount charged.

5.4 Taxes & Statutory Levies

All fees are specified in IDR and are inclusive or exclusive of statutory taxes (such as Value Added Tax / PPN) as indicated during checkout in accordance with prevailing Indonesian taxation laws.

6.1 Instant Electronic Delivery

All Tournament Credits and digital subscriptions provided by Qlutch are intangible digital goods delivered entirely electronically. Upon successful payment verification and settlement confirmation from the payment gateway (Midtrans), the purchased credits are automatically and instantly credited to your registered Qlutch account balance.

6.2 Delivery Confirmation & Assistance

Because delivery is digital and automated, no physical shipping is required. If your purchased credits do not reflect in your account balance within 15 minutes of payment completion due to bank network latency, please refresh your dashboard or contact our technical support team with your payment confirmation order ID.

7.1 Non-Refundable Used Credits

Due to the digital and instantly provisioned nature of Tournament Credits, any credits that have been used, redeemed, or allocated to host an active, ongoing, or completed tournament draw are strictly non-refundable.

7.2 Credit Validity Duration & Expiration

Tournament credit packages are subject to fixed validity periods starting from the date of purchase (e.g., 60 days for Starter Free Trial, 90 days for Single Credit, 365 days for Growth/Pro Packs, and 730 days for Enterprise Packs). Unused credits expire automatically upon the conclusion of their validity period and cannot be extended, transferred, or refunded.

7.3 Eligible Refund Scenarios

Refund requests are only evaluated and granted in specific exceptional cases: (a) duplicate billing caused by technical gateway errors, (b) verified fraudulent or unauthorized transactions, or (c) proven technical failure where purchased credits failed to deliver to the account balance and could not be provisioned by our support team.

7.4 Refund Request Submission & Processing

To request a refund for an eligible transaction, you must submit a written request to support@qlutch.id within 7 (seven) calendar days of the transaction date. You must include your transaction order ID, payment proof/receipt, registered email address, and reason for the request. Approved refunds will be reimbursed via the original payment method or bank transfer in IDR within 7 to 14 business days.

8.1 User Content Ownership

You retain full ownership of any tournament names, club logos, player rosters, banner images, and match scores you submit or display on the Services ("User Content"). By uploading User Content, you grant Qlutch a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content solely for operating, streaming, and promoting the platform.

8.2 Content Standards & Prohibitions

You represent and warrant that your User Content does not infringe any third-party intellectual property, privacy, or publicity rights, and contains no unlawful, defamatory, abusive, or obscene material.

8.3 Right of Removal

Qlutch reserves the right, at its sole discretion, to remove, edit, or block any User Content that violates these Terms or is deemed detrimental to the padel sporting community.

12.1 "As Is" and "As Available" Disclaimer

The Services and digital goods are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, statutory, or implied. Qlutch assumes no responsibility for accuracy, timeliness, uninterrupted operation, or temporary server downtime during maintenance or external cloud service interruptions.

12.2 Limitation of Liability

To the maximum extent permitted by applicable Indonesian law, Qlutch, its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, tournament revenue, or business reputation) arising out of or related to your use of the Services.

12.3 Tournament Operations & On-Court Disputes

Tournament organizers are solely responsible for managing physical tournament venues, referee assignments, player safety, on-court disputes, prize pool payouts, and regulatory compliance at their facilities. Qlutch acts strictly as a digital scorekeeping and bracket software provider and assumes no liability for on-court occurrences or physical injuries.

15.1 Governing Law

These Terms and Conditions, all transactions, and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws in force in the Republic of Indonesia (*Hukum Negara Republik Indonesia*).

15.2 Dispute Resolution & Jurisdiction

In the event of any controversy, claim, or dispute arising out of or relating to these Terms, the parties shall first attempt in good faith to resolve the dispute amicably through mutual deliberation (*musyawarah*). If the dispute cannot be settled within 30 (thirty) calendar days, it shall be submitted to the exclusive jurisdiction of the competent District Courts within the territory of the Republic of Indonesia.
